This Notice outlines the legal basis on which we process your Personal Information on our website located at https://amirazz.com/ (the “Site”) and on our software application named “Amirazz” (the “App”).

1. Your Consent

(a) Providing Consent

Having reviewed this Notice (or having been given the opportunity to do so) and by using the Site or App or by clicking on the “I Accept” icon on the pop-up that opens when you first use the App, you expressly consent to all of the provisions of this Notice and to the Terms of Use governing the use of the Site and App (the “Terms”).

(b) If you Elect Not to Provide Your Consent

You may choose to not consent to the processing of your Personal Information in accordance with our Notice.

However, if you choose not to consent or you later withdraw your consent, then we will not be able to provide you our services, which include both our Site that contains informational resources and our App (i.e., the Amirazz Marriage App) that you can used to engage in Halal Dating, which hopefully leads to an Islamic-guided Marriage (the “Services”).

(c) Withdrawing Consent

Except as required or permitted by applicable data protection laws, we will not use or disclose your Personal Information for any purpose for which you refuse us consent or later withdraw your consent. You may at any time withdraw your consent with future effect and without affecting the lawfulness of the processing of your Personal Information based on your previous consent.

If you withdraw consent, you agree that despite this withdrawal we may continue to use the Personal Information previously provided to us (i) to the extent that we are contractually obligated to do so, (ii) to the extent necessary to enforce any contractual obligations you may have with us, and (iii) for any other legitimate purpose (including fraud prevention) permitted by applicable data protection laws. If you withdraw your consent to use and disclose this information, we may no longer be able to communicate with you or provide you the Services.

2. What Is Personal Information?

“Personal Information” is broadly defined to include all information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual. Personal Information could be as simple and direct as your name, but it could also be less explicit like how a certain individual interacted with a website or an advertisement.

Islam establishes that Privacy is a basic and sacred human right. As a Muslim company leading a Muslim dating app, we seek to further these rights. Islam does not make this right to Privacy contingent on where you live. Rather, this right is available to everyone.

Accordingly, no matter your residency, you have the following rights with respect to the Personal Information that we collect, use, or share:

If you’re not satisfied with our response, you may complain to your applicable Supervisory Authority. If you’re unsure who the proper Authority is, let us know, and we’ll endeavor to provide you with the data about the applicable Authority.

4. What Personal Information do we collect and why?

Please differentiate our Site and our App. Our Site does not collect your Personal Information, and accordingly does not use cookies or device identifiers, which are also discussed below. Our Site is exclusively used for informational purposes: to apprise you of our Services. Our App is where the magic happens.

The Amirazz App is a matchmaking service. It goes without saying that we can’t match you if we don’t know anything about you.
Accordingly, we need to collect your Personal Information for the following purposes:

To facilitate our Match-Making Services, we require the following information:

  • Name: A name is required when you sign up for the app to create a profile. Your name is not available publicly. It’s used in conjunction with your Identification described below to verify you’re a real person.
  • Username (Nickname): You will also create a username / nickname that will identify you. This is shared with other members.
  • Personal Identification Issued by State/Provincial Authorities: Your Identification will not be shared with anyone. The sole purpose of seeing this is to verify that you’re a real person and to check whether you’re of legal age.
  • Date of Birth: Your date of birth will be shared with other members to help them determine if they want to connect you.
  • Photos: Your photos will be displayed on your account profile for other members to see.
  • Email and Phone Numbers: Your email and phone number will not be shared with anyone. Our purpose with the email and phone number is to communicate with you and provide an initial authentication code. You may also login with Facebook.
  • Geolocation: We ask for your location to pair you with members in your area.
  • Gender Identity: We use your gender identity as determined by Islamic Rules to base our Services around you because some features are based on gender. Your gender will be shared with other members.
  • Marital Status: Your marital status will be shared with members so that they may know your status and proceed with the decision on how to approach you.
  • Employment- and Education-related Information: Your highest level of education and current salary grade will be shown to other members to facilitate the matchmaking process.
  • To purchase services that we offer to assist with the match-making services noted above. We do not store your financial information, rather we use a payment processor (Stripe) who will collect your financial information and us it to process the transactions on behalf of the us. Please look at Stripe’s privacy policy / notice for more details on how they protect, use, and store your Personal Information.
  • When you sign in with social media: You may choose to enable, log into, or sign on to the Services through Facebook. When you connect using your Facebook account, we may collect Personal Information that you have provided to Facebook. For example, when you log in with your Facebook credentials, with your consent, we may collect Personal Information from your Facebook profile that is permitted under Facebook’s Terms of Use – such as your email address, profile picture, and friend list. We use this data to provide, enhance, and personalize the Services (e.g., to help connect you with or suggest friends within our Services). If you do not want to provide us with this data, you need to adjust the privacy settings on your Facebook account.
  • To communicate with you, regarding offers and promotions that may be of interest to you or any updates to the Terms, this Notice, or the Services.
  • To respond to you, after you have made initial contact with us regarding inquiries, comments, or concerns; requests for technical support; or any other communication.
  • For analytics, such as to better understand, analyze, and respond to your needs and preferences, as well as to learn how visitors including you use the Site or App in order to improve it; subsequently develop, enhance, and/or provide products and services to meet those needs and preferences; or keep track of your product preferences and instructions and analyze that information.

Please note that you may provide us with additional information not specified here. For example, on your biography, you may discuss your education history.

(a) Decisions made automatically

Automated decision-making is an invisible feature that we use to improve our Services and help you find a partner through halal dating. We use these features for two reasons:

First, to help you find a partner. We use your Personal Information provided to us to power our matching algorithm, which matches you with other members we believe are compatible with you. We also use this process to match you to other members. However, you may override our automated decisions by manually changing the filters. For example, you may modify your location, education, and hobby filters to generate new matches.

Second, to promote safety. As part of our moderation efforts, we automate decisions to make it easier to find illegal and unauthorized actions and to try to prevent them before they happen. Sometimes automated decisions may lead to suspension or account closure.

(b) Marketing Communications

Where we are legally required to do so, we ask you for your prior consent before providing you with promotional materials or information (referred to as “Commercial Electronic Messages, or “CEM”s). You may withdraw your consent to the receipt of CEMs at any time. This will not affect the processing of your Personal Information in relation to our Services.

(c) Cookies and Device Identifiers

We do not use “cookies” or device identifiers.

(d) Site Usage Information

Our Site or App currently does not gather traffic patterns, usage information and other aggregated data. However, we may in the future use such information to evaluate our visitors’ preferences and the effectiveness of our Site and App. We may also allow third parties to collect aggregate data through our Site or App. In either case, this aggregate usage data would not identify you individually.

(e) Do Not Track Requests

We do not track you over time and across third party websites to provide targeted advertising. Accordingly, we do not respond to Do Not Track (DNT) signals.

5. How We Collect Personal Information

The Personal Information that we collect varies depending on the nature of and reason for your interaction with us. We collect Personal Information:

  • when you register for an account or interact with our App or sign into your account using Facebook;
  • when you communicate with us or sign up to receive promotional materials or information via email, push notifications, or text messages.
  • when you engage with our online communities, including when you interact with our social media pages or otherwise enter information into comment fields, blogs, message boards, events, and other community forums sponsored by or affiliated with Amirazz.
  • When you connect with us on social media, such as on Facebook, Instagram, Pinterest, TikTok, Twitter, and Youtube (“Social Media”), we may collect Personal Information that you have provided to that social media.
  • When we leverage and/or collect location data from the environment and other tracking technologies.
6. Who is Your Data Controller and Processor?

Amirazz Inc. is both the data controller and processor for the processing activities described in this Notice. However, we also share your Personal Information with third party companies that perform subprocessing functions on behalf of us, such as processing payments or storing your Personal Information.

7. Legal Basis of Processing.

We process your Personal Information because such processing is necessary for:

  • exercising our rights and performing our obligations under any contract we make with you;
  • the provision of additional services, such as marketing communications, where you have provided your consent;
  • compliance with our legal obligations; and,
  • legitimate interests pursued by us, which generally involves the efficient performance and management of our business relationship with you
8. How we share your Personal Information

We do not sell Personal Information.

We will not share your Personal Information, except:

  • to third parties performing clearly defined subprocessing functions on behalf of us (such as analyzing or storing data, providing marketing assistance, providing search results and links, and verification of data provided by you). For example, we use Stripe to process payments for our Paid Features and Bluehost to store your Personal Information. Any processing of your Personal Information by these sub-processors will be protected by an agreement regarding privacy and data security;
  • where we are required by law to disclose Personal Information; in connection with any legal proceedings or prospective legal proceedings;
  • in order to establish, exercise, or defend our legal rights;
  • to the purchaser (or prospective purchaser) of any business or asset which we are (or are contemplating) selling. We will require any person or entity to whom we provide your Personal Information to agree to comply with our then current Notice. We will take reasonable commercial efforts to ensure that they comply with our Notice; and,
  • in the event of a transfer of ownership or assets, or a bankruptcy, of Amirazz.
9. International Data Transfers

We are proudly Canadian, and we store and process all of your Personal Information in Canada. Some of you reside outside of Canada. In order for us to properly store and use your data, you consent to the transfer and processing of your Personal Information to Canada.

10. How We Protect Your Information

To protect your Personal Information against accidental or unlawful destruction, loss, use, or alteration and against unauthorized disclosure or access, we and our sub-processors use appropriate physical, technical, and organizational security measures

11. Your Rights to Access, Portability, and to be Forgotten

(a) Your Right to Access

The disclosure of information will be provided to you free of cost. If your access request is manifestly unfounded or excessive, in particular because of the requests repetitive character, then we may levy a charge to cover our administrative expenses (we also may refuse such repetitious or vexatious requests for access).

We reserve the right to decline your request where the information requested:

  • would disclose Personal Information of another individual or of a deceased individual;
  • is subject to legal privilege;
  • is personal health information that was not provided to us directly by the individual requesting access;
  • is not readily retrievable and the burden or cost of providing would be disproportionate to the nature or value of the information;
  • does not exist, is not held, or cannot be found by us, could reasonably result in serious emotional harm to the individual or another individual, or serious bodily harm to another individual; or,
  • may harm or interfere with law enforcement activities and other investigative or regulatory functions of a body authorized by statute to perform such functions.

We also will not disclose the Personal Information where a law of your country, state, province, or other subnational entity would bar such disclosure.

(b) Updating or Correcting Your Information

You may in most cases correct or update your Personal Information by accessing your Account directly, or by instructing us to do so on your behalf.

(c) Your Right to Data Portability

If we provided you access to your Personal Information, we will provide it to you in a structured, commonly used, and machine-readable format. If you made your request electronically, we would provide access in electronic form unless you request otherwise. Your request may also be delivered by mail. This format will be, to the extent technically feasible, in a readily useable format that allows you to transmit this information to another entity without hindrance.

(d) Data Retention and the Right to be Forgotten

We do not hold onto your data forever. Instead, our default is to retain your Personal Information:

  • until it is no longer necessary for the purposes for which it was collected or otherwise processed;
  • to comply with legal obligations (such as retention obligations under employment, tax or commercial laws); or until you request that we delete it.

If you make a deletion request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless we or our Service Providers must retain your Personal Information to:

  • complete the enquiry for which your Personal Information was collected, provide a service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
  • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; comply with any legal obligation; or, make other internal and lawful uses of that information that are compatible with the context in which you provided it.

In order to maintain or enhance our Services it might be necessary to change this Notice from time to time. We therefore reserve the right to modify this Notice at any time, subject to applicable data protection laws. Please visit this Notice from time to time for information on updates to this Notice.
